now at 3 tragedy striking on the way to work in alameda county sheriff's office. dispatcher. >> has been killed by a suspected drunk driver. thank you so much for joining us here on kron. 4 news at 3. i'm justine waldman. this dispatcher died at hospital over the weekend after working with the sheriff's office for almost 3 years. this afternoon. she's being remembered as a loving mother and co-worker kron four's. tiffany justice joins us now live from the newsroom to share the legacy that this dispatcher leaves behind. thanks for joining us. office speaking with kron 4 today, remembering a colleague who brought joy to the office a life cut short on our way to help others. >> was a she was a force and she was described as the best of us. and now the best of us is her family described her as a start. >> the alameda county sheriff's office mourning the loss of one of their own after an emergency services

dispatcher was killed by a suspected drunk driver sunday night at 22 feet. now is heading back to her job to work a double when her life was taken at the intersection of east 14th street and 100 50th avenue in san leandro. she loved being the person >> that received those calls for help or assistance. and she just took great pride in it. she took joy in it the day that she was tragically taken from us. she had work her shift and had left at 07:00pm and our dispatch center needed additional help and she agreed to come back. so she was on her way back to work and made just about 3 blocks shy of our dispatch bunker. >> now started with the department back in 2021. quickly making her joyous presence was promoted last year. she was highlighted just 2 weeks ago for national public safety week. fyi now spoke about her love for

family. >> another one, my favorite family. i have to use on to not one of them only about a month and a half old. they are the best part of captain says the family is appreciative of all the love and support from the sheriff's office and surrounding law enforcement agencies. the 32 year-old driver was arrested for driving under the influence and was taken to jail where she remains. >> police say she crashed into females car, causing it to roll over. >> you know, if there was ever a moment to help people understand help devastating drinking and driving can this is an example. unlike other. daughter, a sister. honestly, the only thing i want to know is that justice gets served. >> we're being told a memorial is being planned. we do not fino leaves behind a young daughter in a loving family.

the semi and police department is leading this investigation. reporting live in the newsroom iustice kron. 4 news. tiffany, thank you. >> a brooklyn police officer does not have qualified immunity and a civil rights lawsuit stemming from an incident in which his police dog scout a shoplifting suspect. this is according to a federal district court ruling. we're going to play that body camera video from the incident that happened in february of 2020. but we do want to warn you some viewers may find the images disturbing. so when this happened, officer ryan resent us was responding to a report of a shoplifting suspect from an ulta beauty store. his german shepherd found tamika bates hiding in the bushes and the dog then clamped down on her scalp for about a minute. a bite that she says has left her with ongoing traumatic brain injury. the civil rights lawsuit will resume later on this month. we are following now. some breaking news out of oakland. dozens of

firefighters currently battling a fire at a residential structure. this is near laney college video from fire. crews is showing a smoke still coming out of the roof of this 2 story building. this is at east 8th street and 6th avenue. the fire ripping through one building. but the second building that's being threatened, we see fire crews there on the scene using the ladder truck to use water from above. also trying to get some windows or plywood there off of the side of the building. we have learned that no one is hurt. when we get more details about this fire that's breaking right now. oakland will be sure to bring them right to you. and in the south bay, one man is dead and another is in custody following a fatal accident in san jose kron. 4 s charles clifford has the details. well, here in san jose, one person has died and another man is in custody following a collision here. >> at center and capitol expressway early on tuesday morning. now, according to the san jose police department, a man driving a red truck was speeding eastbound on capital

when he ran the light at center and struck a cyclist, an adult male who was headed northbound on center. the collision occurred near the crosswalk at the intersection. the red truck, according to police, then lost control and struck another vehicle. a white truck. unfortunately, the cyclist died from his injuries here on scene. the driver of the red truck was taken into custody. the san jose police department spent the entire morning here up until about noon investigating. taking measurements looking for surveillance video talking to witnesses trying to figure out exactly what happened so far. we don't know what if any charges, the driver of that red truck will face. also, we don't yet know the identities either of the driver of the truck or of the victim. >> but for now in the south bay, charles clifford kron, 4 news. >> and staying in the south bay, no criminal charges have been filed after an 11 year-old girl was hit and killed by suspected dui driver in cupertino. investigators say the girl was one of 4 kids

standing on the sidewalk at foothill and stevens creek boulevard last month when a pickup truck plowed into them. the other kids aged 8, 7, 4 are okay. the suspected driver has been identified as adam, who he was allegedly high when he crashed into the kids. he did bail out of jail last week and remains out of custody. detectives are waiting now for a top college. the report to be finished. we're learning some new details right now. but a man accused in 2 hit and runs in san francisco, including one that involves a middle school s. th all happened this morning. san francisco police got a report about a person hit in the area of jones and market streets. that's in the tenderloin that victim is an urban alchemy worker and did go to the hospital with non-life-threatening injuries. officers tried to pull over the driver, but they say that he would not stop. so they chased him. and police say he then hit a 14 year-old girl near francisco middle school. she's a student there. she

fractured her shoulder and ankle. but we have learned she's expected to be okay. and then san francisco police called off the pursuit. the suspect is accused of crashing into parked cars before coming to a stop at the embarcadero and green. that's where this video is from. he was taken into custody and then went to the hospital with non-life-threatening injuries. the suspect is known to police and according to police does have a criminal record. have more on this story coming up at 5. and mayor lamar thorpe unveiling a first of its kind on demand. driverless public transportation system today in eastern contra costa county residents will be able to access glide cars and they're saying this will help to reduce congestion throughout contra costa county, the dynamic personal michael micro transit project will increase public transit, accessibility for the fast-growing communities of pittsburg, antioch, oakley and brentwood. the project will be jointly administered by contra costa

>> in the north bay, a monthslong pilot program is now underway in the city of allay a street. >> that divides to schools is going to shut down. 2 car traffic during the weekday school hours. hot for some to call reports. this is in response to several shootings and frequent speeders, though, sometimes made that area unsafe. >> in response to shootings outside valais hill high school. the vallejo city unified school district is closing the street out front to traffic during school hours for the remainder of the school year. gun violence and speeding. >> that's really down there by train tracks and gas station. the nebraska street closure pilot program started this week and will end june 7th.

>> the school district says recent shootings and high-speed rates demonstrated in front of the high school and john finnie education complex across the street. we're deciding factors in the closure adding that the inappropriate and unsafe activities have put students and staff at risk of really do see on the of most time because they always live make everybody staying but many students and staff are well aware of the concerning shootings that have happened in the area the past 2 years. >> in 2022 of allay high school staff member. >> was shot after breaking up a fight between students and a group of men last year. a girl was injured by a stray bullet near vallejo. high months later, a teenage boy was shot and for the campus after a football game wrapped up all of the victim survived definitely around the pandemic. >> time it's and we have been here a few years. it's definitely kind of. we've heard more gunshots since.

right now. that's the view from mount temple, pius. but the big story is the winds, gusty winds coming out of the north, triggering a gale warning right along the coastline. and that starts at the southern oregon border stretches all the way down to san diego, stretching right san diego, stretching right across. of course, our coastal gusting 20 30 miles per hour, even gusting to 40. and if you head inland, of course, it's breezy. but by tonight, the winds are strong enough to trigger a high wind advisories stretching from the central valley right down toward delay house. so it is breezy and of course, things are going change. but the good news about the breezes as we have great air quality from the north bay to the south and parts of the coastline and east bay least air quality is not a problem. high pressure is bringing us beautiful, beautiful weather. yeah, we get the breezes, but we also get the warm conditions. in fact, a warming trend kicks in tomorrow with temperatures in the 70's in some spots, even in the 80's golden gate park,

70 degrees to start to head toward the coastline. of course, it's little bit cooler with the marine influence to start to head toward the bay shoreline. 71 in san bruno and burling in looking at upper 70's in mountain view and then down into the 80's and some your part. the san jose area. so as we head toward the east bay and the south bay, you can pick your spots, 70's and 80's pretty much everywhere. it's warm tomorrow. even warmer yet. as we look toward the 7 day forecast, you can see that warming trend continuing through thursday, friday, saturday and finally toward the end of the weekend, the number's taper off and not and drop of rain. not in this forecast. all adult film actress stormy daniels took the stand in the hush money trial of former president donald trump. today. daniels described how she met the former president. >> at a celebrity golf tournament in lake tahoe in 2006. she was 27 at the time. she later testified in great detail about a encounter with

mister trump saying that she thought she was going to dinner with him in a restaurant but was asked to meet her at his hotel suite. she said the trump told her she reminded him of his daughter, trump's former personal attorney and fixer, michael cohen said that he paid daniels $130,000 to keep quiet about this alleged encounter that she had with the former president. mister trump spoke about this while walking into court today. >> this put it construction costs. >> purchase. she electrical the legal expense that we put legal expense. >> trump faces 34 felony counts of falsifying business records in an attempt to cover up the payments to daniels during his 2016 election campaign. he has pleaded not guilty if convicted. mister trump faces 4 years in prison.

the case will resume with daniels back on the stand on thursday. tiktok and its chinese parent company bytedance suing the u.s. federal government to challenge a law that could force the sale of bytedance steak or face a ban saying that this law is unconstitutional. the lawsuit may be setting up what could be a legal fight over the future of the app in the united states. the company claims the law which was part of a bigger foreign aid package is, quote, obviously unconstitutional. opponents of the law argue that chinese authorities could easily get information on americans and other ways, including through commercial data brokers that rent or sell personal information. the faa has launched an investigation into claims that some of boeing's employees falsified inspection records for the company. 7.87 dreamliner jet. boeing disclosed this matter to the faa last month. the claim involves the company's south carolina plant. it says several employees did not

a warning for future retirees, full social security benefits are expected to run out by the year 2035. this is according to >> the social security board of trustees after 2035. payroll taxes and other income sources will only be able to cover an estimated 83% of benefits owed. so in its report, the board of trustees, urge congress to take action to shore up this program. the irs is issuing its final warning to collect the remaining 1 billion dollars that's left an unclaimed federal tax refunds. the agency says that 1 million people across the nation may 17th deadline to get their unclaimed refunds for the 2020 tax year. they say california,

>> so this is been a topic of conversation for a few years in san francisco, the great highway. whether or not it should stay closed or remain open to cars. so now there's a new proposal for a mile long portion to closed to traffic for good by early 2026, as part of this project to protect the cities, western shore from rising sea levels. kron 4 s charles clifford has the details. >> last week, san francisco's land use and transportation committee advanced a plan to close most of what's known as the great highway extension between slow to skyline boulevard for decades. erosion has eaten away at the beach and bluffs between the ocean and this section of the great highway cleaning sand off the roadway has become a constant problem, especially after winter storms. there are also frequent closures of this section of the great highway. more than a decade ago. san francisco develop a long-term plan to deal with climate change and erosion along the city's western edge. closing this portion of the great

highway has been under consideration ever since in place of the roadway. the city wants to build a network of trails a plaza and possibly a staircase leading down to the beach. but the plan is not without problems. that would need to be addressed for one of the main entrance to the san francisco zoo is along this section of the great highway. if it closes a smaller entrance near 47th avenue would need to be redesigned. all right. for neighbors we talked to on tuesday were in favor of the plan, noting that the erosion problem is getting think it's always fact further down the park. not going to close at us. boy, the time plan will still need approval from the san francisco board of supervisors. >> they are set to discuss the issue later this year. but for now in san francisco, charles clifford kron, 4 news. >> america's worst city to drive in happens to be located right here in the bay area. according to a recent study from forbes advisor, oakland is the worst cities to drive

in this study, evaluating close to 50 metropolitan areas and took a number of factors into account, including driving experience safety, the cost of car ownership and access to car maintenance open, received the top or maybe get the bottom spot on the list for many of these reasons. the city lead in fatal crashes, high gas prices and along average commute time miami came in second and then san francisco came in as the 3rd worst. today. san jose police discuss the city cinco de mayo festivities. the department calling all the events pretty successful and well attended and saying they were very family-friendly. however, police did say there were disruptive behaviors going on by visitors unrelated to any events and some of the things that police had to deal with happened to be reckless driving sideshow activities. officers getting bottles thrown at them and then from a 3rd through may 5th police say there were 17 felony arrests.

52 misdemeanor arrests. 8 cars were impounded 156 traffic citations and they seized 6 guns. there was a gun buyback event over the weekend. that was a success in san mateo county. the sheriff's office says they recorded a record number about 300 guns. 24 assault weapons for ghost guns and a machine gun were all turned over. people were paid between $5200 depending on the firearm. the sheriffs are but says they plan to host another gun buyback this year. but no date has been set. this is the 6 year of this program. new at 3 a bill to expand disaster relief funding is being heard in the state assembly this afternoon. a b 17. 86 would create 2 funds to help individuals, families, communities in crisis who may not qualify for disaster relief due to the extent of or the reason for the damage the

bill would also set aside 100 million dollars for disaster relief and 400 billion dollars for tribal and local governments. under the measure people impacted by climate change but also qualify. for your health this afternoon. new findings from the cdc showing california is the second healthiest state in the country just behind hawaii. the results compare states by the average life expectancy, obesity rates and activity levels. data showing the california has one of the highest life expectancies averaging 79 years old. the cdc is saying that the state has one of lowest obesity rates of 28%, along with 80% of adults. also reporting that they do some kind of physical activity. this is a major improvement from last year when california ranked the 10th healthy a state in the nation. all right. there's a new housing bill that's making its way through the state legislature right now. it's backed by 2 groups who are

often at odds with one another and assembly member. matt haney introduced this bill this month. he says it's to streamline the conversion of historic buildings into housing in downtown areas all across the state, including here in san francisco. so assemblymember hania's turning us here now live during kron for news at 3 to talk more about this. thank you for joining us. thanks for having me. good afternoon. so talk to me a little bit more about ab 30 68. if you're trying to convert these downtowns as we're hearing, it's sort of that 95 life is really outdated. so many of these office buildings in san francisco are vacant has a very low occupancy rate. you want to turn them into housing. but we've hearing there's just so much red tape. the permitting process is difficult. just imagining all the construction costs as well. so what are you trying to do to encourage a builders? to think that this is interesting and also how do you make these changes on a state level? >> well, san francisco, unfortunately just hit a over 35% vacancy rate. says that's

record for us. and sadly, this is true across the we have had a changing the way people work. many people are now working remote and we're just not going to go back to the skill that we had before the pandemic of people in these huge office all in cubicles. and so we've got these office buildings that have been built downtowns and many of them are sitting vacant. the same time, we have still some of the highest friends in the and a tremendous need to build new housing. so we've got an opportunity here. we just have to make it work and we have to make it possible. and as you said, under our current laws, it's really hard to do expensive. there treated like ground-up construction. so you have to get all of these additional approvals and permits in heels and fees all of that. and it's hard to do with taxes. and so we put together a that i'maauthoring that we is going to make it a lot cheaper a lot quicker and a lot easier to convert these

buildings to at because you have mar del it's about making that conversion possible. and so some of that, as you said, is also making sure for the buildings that are all there, which is are the buildings were a lot of this is more feasible that we protect and figure out what part of that building needs to be protected and then make conversion feasible to get done. >> yes, your bill here is about the u.s. historic buildings, which probably have some really beautiful architecture, some really unique features. so how do you go about protecting the integrity of the building and keeping its character of also making it updated. interesting and feasible for someone to live it. >> these other buildings are actually a lot more feasible foroconversion and then or once back in the the office buildings part don't that differently the residential buildings. there each person had individual office. they have a bathroom which they had a window. and so converting those 2 apartments is actually a lot easier the huge new

buildings like a sales force tower, for example. but some of those older buildings are also very special. and you don't want get rid that historic elements of our downtown at the same time. so brought together the historic preservationist and the housing advocates and we came up with a compromise here as to how we can determine the parts of the building. better start off. and the passat in a streamlined and then get moving on housing to be able to maintain the part of the building. that's historic, but also being able to convert some of the inside of the building into housing. >> just mentioned these 2 groups that are usually at odds with one another, but they are supporting this, which is, i guess, a good sign and how this is going. what are these incentives that you're offering is that the construction companies core these incentives for to start this process? >> can be somewhat expensive to convert these buildings to housing. it's complicated, as you can imagine, with the bathrooms and the plumbing. and that's all of these things

that need to happen. so we have to make this feasible because it's not helping anyone right now to have building sit empty. so what we're allowing is for people to be able to defer their property tax for a set number of years and then be able to reinvest some of those into an incentive to help with the costs of the of the conversion, particularly for the portion of the conversion that will go to affordable housing were also capping some of that time lines and heels of making up by right conversion. all these things will save money and make these a lot more we're not helping him win by keeping these fake. the more people downtown having more people live downtown also making our downtowns more active, helping small businesses cleaner i think it's a win-win for everyone and really quickly here, where does this bill now stand and becoming a law? on the way to the assembly it's it's it will leaving the appropriations committee has had bipartisan people are

year. during an exclusive interview, our capitol correspondent eytan wallace spoke one on one with the general, the california national guard about the ongoing efforts to fight this epidemic. >> well, the adjutant general here at cal guard headquarters near sacramento tells me the state is doing all it can to seize fentanyl, taking it off the streets. >> the fight against fentanyl data just released by the newsom administration show since the start of the year, the california national guard's counter drug task force has assisted in the seizure of more than 3.4 million fentanyl pills confiscating an estimated 7,100 pounds off the streets every time you take drugs off the street, you're making the streets safer. major general matthew beevers is the adjutant general leading the california national guard part of his many responsibilities include forming partnerships with law enforcement agencies across the state to seize fentanyl, all of it in the state where as of 2022 figures from the department of public health showed more than 6,470
