encampments in san francisco. the data mayor london breed has that she says proves that is the case. despite many saying they can't tell the difference. when fun time from the bay area's local news station. you're watching kron. 4 news. >> 10, good evening. thanks for joining us for kron for news at 10. i'm ken wayne and i'm vicki liviakis. our top story tonight. >> the man who says san jose police say shot 2 of their officers is now facing 2 charges of attempted murder. new court documents show kevin brionna is showed up at a south san jose hotel last week with a gun to see a woman he used to be in a relationship with. and that's when the woman reportedly called police. >> four's jack molmud reports from san jose after talking with a man was staying at the hotel during the shootout. >> new court documents reveal details about the shooting that happened here where a suspect opened fire against to san jose police officers. we learned about the incident

happened not in the room but in a hallway here at the hotel. we also learned that the suspect dropped out of the 3rd story window here and fell into these bush's before police found him with several gunshot wounds your benefit already been 30 in the night. and then he heard somebody its seal, says he and his wife are watching tv at the extended stay. america. >> and seemingly right outside their door. >> and then suddenly hard, some loud noise like the middle noise. i i didn't gunshots people inside and had no idea what did some late. so my dog started barking. that's where i knew that something really because he's going on. seal said he thought about calling the cops, but he soon realized what was happening. yeah, really hard it was like a ghost. going to get see that. a shootout. 2 officers shot one of them with just a year of experience on the force. the suspect kevin angelo briones reportedly shot

several times. we don't us is charged with 2 counts of attempted murder on the police officers. the police report says the woman briones reportedly showed up for is a domestic violence survivor. >> and says her during this had a previous relationship, 3 young kids were at the hotel with the woman at the time of the shooting. what we had was an armed, dangerous felon showing up in the middle of the night. police say officers stopped briones from possibly hurting the woman and the kids nights events offer a stark reminder. >> of the solemn oath they take to protect and serve our city. onus is a felony, which means if he's convicted, these charges could put him in prison for life. yeah, it is. i think pretty bad. put provision. but the city and for seal, he says he and his wife now are worried that staying at the hotel was not a good. >> to hear that it's going to happen will be on us was supposed to have his first court appearance today, but he is reportedly still recovering from the injuries sustained during the shootout. meantime, san jose police tell us that one of the officers was treated and released from the hospital. the other one is still in the hospital in

critical condition. but police say they are expected to survive. we're in san jose jack moment. kron 4 news. another big story we are following for you tonight. bay area reaction. >> coming in after hamas is accepted, a cease-fire proposal to halt its war with israel. but israeli prime minister benjamin netanyahu is questioning the terms of this proposal. it is instead stepping up attacks on the city of rafah. >> the one hand he's got a pressure from this hard right-wing ministers. you don't want any kind of real cease-fire and they starting to withdraw from his narrow coalition, which would then bring him down, require new elections. other hand have been tens of out in the streets of the friends and relatives of the hostages demanding that that that tv willing to compromise. >> at directly across the pro-palestine encampment on campus. a memorial is set up commemorating those killed and held hostage by hamas. it falls in the same day as the

sides. the proposed cease-fire deal, including from students who have been calling for that cease-fire. other news tonight, the number of tents part tense on the streets of san francisco's hit a 5 year low. that's according mayor london breed. >> our grant lotus here in studio with a look at the mayor's findings and what she's saying is going on grant optimism there. can the mayor's office says they found more than 300 tents and structures on the streets across the city. >> and that is a 41% drop since last summer. the mayor's office credits improved efforts to offer shelter and housing. also, they say they've been cleaning up encampments. however, some people we talked to today in san francisco say they can't really tell the difference. >> more homeless people. i see more human defecation on the streets. i've actually seen naked in the middle of the financial district. >> yeah, the mayor says encampment outreach teams have

conducted 242 operations this year and made 1530 encounters with people interactions of those. the city says 30% of the time people took the shelter that was offered 60% of the time. they refused it and 10% of the people already had housing. they were just there in the streets. the mayor says this indicates this is not just about homelessness, but it is related to issues like fentanyl and mental health challenges. complicated issue. vicki and ken, back to you. indeed. thank you. grant downtown areas across the state. >> could be getting more housing. a new bill looks to require cities to convert historic buildings into housing unit. san francisco assemblymember matt haney who introduced the bill says that it would allow state lawmakers to quickly green light office to housing projects, putting an end, a lengthy and costly approval processes. the bill now heads to the assembly appropriations committee for hearing this wednesday.

after her car was hit by an alleged drunk driver. >> investigators say it happened last night at 14th street and 100 50th avenue. the driver has been arrested. the victim. antoinette fun now died in the hospital after investigators say her car was hit from the side and flipped over. they say she was on her way to work. in cupertino. >> an 11 year-old girl has died after she was hit by a suspected dui driver. investigators say that the girl was one of 4 children who were standing on a sof foothill and stevens creek boulevard last month when a pickup truck just plowed into them. the girl was taken to the hospital where she fought for her life for several days. the other children ages 8 to 7 in 4. they're ok of the suspect has been identified adam woo and police say that he was allegedly high when he crashed into the children. he bailed out of jail last week and remains out of custody so far no criminal charges have

been filed against wooed. detectives are waiting for toxicology report to be completed. >> a homicide suspect has been arrested after the search for him prompted police to put an entire antioch neighborhood on lockdown. happened in the area of gentry town drive and putnam street officials say the suspect carlos policy oce is from stockton. they did not say where exactly they found him or where the suspected homicide took place. the neighborhood was put on lockdown for several hours. police reopen did earlier tonight, all inmates at the federal women's prison in dublin have been relocated. >> this after it was announced that the prison would be closing following a abuse scandal involving several prison officials. 8 employees were charged with sexually abusing inmates. 5 of those employees have pleaded guilty. 2 others were convicted, including the former warden who was sentenced last year to 6 years in prison, according to a spokesperson. all of the women have been either transferred or released.

>> tesla is continuing to lay off more employees according to business insider, the company sent out another round of layoff notices last night. these layoffs are reportedly in the software service and engineering departments. it's not clear how if any of these newest layoffs will affect bay area workers. just last month, tesla announced it was laying off more than 2700 bay area employees kron four's reached out to tesla about the most recent layoffs. but so far we have not heard back. >> the bay area's first wnba team has a new general manager of the golden state warriors announcing today the hiring yemen. she comes from the new york liberty where she was the assistant general manager. she was also the assistant director for team usa women's basketball team. she says that she's excited to build a team from the ground up. >> brings me so much joy about taking this is that it's a blank canvas and there are many that can go into building

>> tonight, bay area groups are responding after hamas accepted a cease-fire proposal to halt its war with israel. the israeli prime minister's office responded by saying that proposal was far from their essential demands and it would send negotiators to continue talks on a ceasefire agreement. this as they start military operations into the gaza city of rafah on the border with egypt. kron four's rob nesbitt has reaction from both sides of this cease-fire deal. when i reached out to a local jewish organization and those who have organized cease-fire, protests in the bay area. >> i was expecting more celebration. both sides seem skeptical that a deal will be reached. since israel wage war against the terrorist group hamas. 7 months ago, we've seen the impacts of protests from college campuses to the golden gate bridge. samara,

robbie, with the arab resource and organizing center has taken part in demonstrations, calling for a cease-fire and was relieved to hear the update monday that hamas accepted an egyptian qatari proposal for a cease-fire. >> a little bit of hope and some relief, right? the idea that maybe all of this carnage. a tense up can finally end after months and tens of thousands of people dead. >> the proposal accepted by hamas called for a permanent cease-fire. u.s. pop of israeli hostages for prisoners and would allow displaced gazans to return to their homes as israel has ordered about 100,000 palestinians evacuate the city of rafah before a ground invasion by militants there. to me, this looks like them trying to pump the brakes on the operation because they know that this is their last holdout. >> and last grasp on on power in gaza, executive director of the jewish community relations council bay area. tyler gregory says hamas must be removed from military and political control of gaza. >> and that all remaining 133 israeli hostages must be freed. what's under consideration is if hamas is

allowed to stay in power at the end of this war, everyone's worried it's going to repeat the attacks said as much they're committed to doing that. egyptian and hamas officials have said that their cease-fire deal would take place in 3 stages each 6 weeks long. israeli prime minister benjamin netanyahu says he will send a delegation to resume negotiations. the israeli military doesn't want to stop pork. >> which like it sounds while to even say that out loud, particularly when light. to what gregory also mentioned his concern for palestinians in gaza calling on israel and other countries to maximize humanitarian aid to civilians in gaza. >> and also urged the idf to exercise caution to minimize civilian casualties. reporting in the newsroom. i'm rob nesbitt kron. 4 news with these talks of a cease-fire. kron 4 visited the pro palestinian encampment at stanford talks to students there. here's what one of them had to say. >> positions still maintains that obviously divestment disclosure is our biggest aim,

questions some placer county sheriff's deputies who investigated the scene almost 3 years ago. our cameras were not allowed in the courtroom today, but the placer county da's office showing some brand new never before seen surveillance video leading up to this video which we have seen in years past of the suspect jogging up into driveway of this poor residents. the da's office believes this is daniel sarah phinney. the suspect in this murder case. new surveillance video also showing who placer county sheriff's deputies believe the cement to scott driving a tan subaru and dropping off. daniel sarah feeney near the sunny side restaurant and lodging off westlake boulevard in tahoe city. then minutes later, other surveillance video showing him walking down west lake boulevard toward this poor residents. the day in court ended as the prosecution was showing phone records from sarah phinney and scott from their verizon and a tnt accounts. we are expecting to hear more from the prosecution and defense tomorrow reporting

some high clouds streaming up above. we do have a couple patches of fog along the coastline tonight. overall, though, you can see that front that is just trying to make its way into northern california, not much energy with that. but once it goes by high pressure, going to build on the backside of that, that's going to really watch the winds start to ramp up outside. so there goes the front dropping just over the great basin. high pressure builds in before, you wind starting to pick up breezy tomorrow. i think windy overnight on tomorrow night into wednesday and probably into thursday as well, at least in the interior valleys of the east and the north bay. you're going to see some very gusty winds in spots. in fact, let's time it out for as we take you through the night tonight. just a breeze out there right now. things calm down a little bit. then you can watch the colors really kind of ramp up as that northerly wind starts to kick in. and that's where we start to see some of those gusts. look at vacaville. 43 miles per hour. some gusts over 40 miles per hour pass across long county as we head through the day on wednesday and possibly early into thursday. that looks like those winds are going to back off a bit. but yeah, you've got to watch out for that. we've got the advisories for high winds going up there. some of those

gusts as high as 45 miles per hour. a possibility traveling in that direction. >> let's take a look at this. 4 people rescued after their boat overturned in tomorrow. u.s. bay marin county fire along with the snow. the county sheriff's department jumped into action sunday afternoon. you can see rescue diver securing a rescue line to get the people out of the water. they are safe. >> coming up, the new rules that could be coming to self-checkouts. plus apple. he's inviting people let loose in cupertino, but not giving many details about exactly what is going on at the event and why the plan to ban menthol cigarettes. he's now being postponed.

>> a ban on menthol cigarettes is getting postpones. the fda proposed a rule to ban menthol cigarettes in 2022. citing evidence showing the products are harmful. the biden administration endorsed the move. but recently the department of health and human services says there are still more conversations to have the decision sparking backlash from antismoking groups. unfortunately, for every day there is a delay. more kids will become addicted to

tobacco and fewer people and their addiction. >> the fda says it is still committed to banning menthol cigarettes, but it's not providing a timeline. white house officials say it will be after the november election. >> lawmakers in sacramento are some bill that would prohibit groceries from grocery stores from offering self checkout lanes that they don't have enough staff under the proposal. self-service checkouts must be limited to purchases of 10 or fewer items and that staff to monitor the self checkout lanes. >> we have to act now to look at this problem. we want to make sure through our bill sb 14. 46 that we have a full service cashier lane will be open before allowing a self-checkout machine to open. we want to make sure that we have staffing ratios for one employee to to checkout machines. one worker to 12 machines is unacceptable.

>> now at 10, 30 alameda county health officials released a full report on why they closed a mcdonald's in oakland. yeah, the report includes major health code violations. this after employees shared with us videos of rats in the kitchen kron four's. gooden was at the mcdonald's near lake merrit when it was shut down and has a look at that new report. >> on friday, the alameda county health department shut down this mcdonald's at 13, 30 jackson street in oakland with customers waiting in line on from the health department. they have some sanitation the season they need to clean up. >> and we saw inspector filling out this health report. it reveals that 7 violations were found at the restaurant, including rodent activity. >> the report explains rodent droppings were seen around the water heater along the walls and wrote it. traps responded as well to hold were seen in the kitchen and a dead rat was found on a trap near the soda syrup boxes. we feel like.

4 news new at 10, a man is dead after a shooting in vallejo. police say it happened about 7.30, last night on north camino alto. >> the cause of the shooting is under investigation. police have not given any details about a possible suspect. 9 mountain view. residents are without a home tonight after their apartment complex caught on fire. video shows crews fighting the flames sunday morning on fayette derive and san antonio road. >> residents were able to get out safely, but there's extensive damage to that building estimated at million dollars. the red cross is providing temporary housing for the 9 residents. the cause of the fire is being investigated. >> highway 9 will be closing in saratoga for 3 days starting wednesday. caltrans says crews will be making repairs on the saratoga creek bridge. the road will be closed from 09:00pm until 07:00am. construction is expected to be completed by saturday morning. >> well, you might be in the month of may, but it's looking more like winter up in the sierra snow is blanketing palisades tahoe. over the

weekend, though, winter storm warning was issued for the east side of this year for the first time since 2005. kron four's chief meteorologist lawrence karnow joins us now with a look. and all that snow. well, lawrence, one that amazing. i mean, some places over 2 feet of snow i mean, sometimes you to be for winter storm to make that kind of snow. but >> this time of year can catch a lot of people off guard. i think even around the bay area, some folks cut off bar guard by all that heavy rain that moved through on saturday. that also was a very, very impressive event specially for may. so i want to show you this outside right now. kind of quiet out there. we've got the fog moved in along the coastline, otherwise drying things out. but boy, what a storm this weekend, one 3 quarters of an inch of rain canfield. almost an inch and a half from that storm all just over an inch and a quarter and half moon bay, san francisco get this almost an inch of rain. that's important because we've data going back to 18. 49 in san francisco and that

was the 17th wettest may day on record since 18. 49, that's impressive. oakland, almost 3 quarters of an inch. a san jose over half an inch of rain. so start out of all these totals. now what we've already had. and here you go over 25 and a half inches of rainfall so far this season in san francisco. that is 117% of normal. and numbers kind of get set in stone now, as we're going to see the drier months move in san jose over 17 inches of rain. that's 132% of normal. still a little bit below average over 16 inches of rain in oakland at 91% of normal and almost 37 inches of rain for the season. and santa rosa, 114% of normal. all right. out the door right now. we've got a lot of 50's around the bay area going to be chilly in some spots inland overnight. tonight, the winds just a little bit of a breeze out there, especially along the coastline. but the winds really we're going to we're going to talking about the next couple days weather-wise is we see those strong offshore winds kicking in least in parts of the north and the east bay high pressure
